Last updated: 2026. These Terms and Conditions ("Terms") govern your access to and use of tblrpicker.com and its related services (the "Service"), operated by TblrPicker ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of terms

By creating an account, starting a free trial, subscribing, or otherwise using TblrPicker, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and that you have the authority to enter into these Terms. If you use the Service on behalf of a business or organization, you accept these Terms on its behalf.

2. Description of the Service

TblrPicker is a tool that scrapes publicly available comments from a Tumblr post you specify, lets you filter entries, and randomly selects winners for giveaways and contests. Winner selection uses a cryptographically secure random process designed to give every eligible entry an equal chance. The Service is provided as a utility to help you run fair draws; it does not run, sponsor, endorse, or administer your giveaway, and it is not affiliated with or endorsed by Tumblr.

3. Free trials and subscriptions

New users may receive a limited number of free trial draws (currently 3) to evaluate the Service. After the trial, continued access requires an active paid subscription. We currently offer monthly and yearly plans, with pricing shown on our Pricing page. We reserve the right to change features, limits, and pricing, and we'll make reasonable efforts to communicate material changes. Plan changes generally take effect at your next billing cycle.

4. Payments and billing

Paid subscriptions are billed in advance through our third-party payment processor, Stripe. By subscribing, you authorize us (via Stripe) to charge your chosen payment method regularly until you cancel. You are responsible for keeping your payment information current. If a payment fails, we may suspend or limit your access until the issue is resolved. All fees are stated in the currency shown at checkout and may exclude applicable taxes, which are your responsibility where required.

5. Cancellations and refunds

You may cancel your subscription at any time, and cancellation stops future renewals. After cancelling, you typically retain access until the end of your current paid period, after which the subscription will not renew. Except where required by law, fees already paid are generally non-refundable, and we do not provide prorated refunds for partial periods. If you believe you were charged in error, contact us promptly at [email protected] and we'll review it in good faith.

6. Acceptable use

You agree to use the Service lawfully and responsibly. You must not:

  • Use the Service for any illegal purpose, or to run giveaways that violate any law, regulation, or platform rule, including Tumblr's own terms and policies
  • Attempt to manipulate, rig, or interfere with the randomization or with another user's results
  • Scrape or process private, restricted, or non-public data, or data you do not have the right to use
  • Use the Service to harass, defraud, or harm others, or to collect personal data for unlawful purposes
  • Attempt to gain unauthorized access to the Service, disrupt its operation, introduce malicious code, or circumvent usage limits, security, or trial restrictions
  • Resell, sublicense, or commercially exploit the Service without our written permission

We may suspend or terminate access for any violation of these Terms.

7. Your responsibilities for giveaways

You are solely responsible for your own giveaways and contests. This includes setting clear and lawful rules, disclosing terms to participants, complying with the platform policies and the promotion and lottery laws that apply to you, awarding any prizes, and handling all communication with entrants and winners. TblrPicker simply provides a fair selection mechanism — the giveaway itself, and any obligations arising from it, are yours.

8. Intellectual property

The Service, including its software, design, text, logos, and other content (excluding the public Tumblr data you process and content you own), is owned by TblrPicker or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, reverse engineer, or create derivative works from the Service except as permitted by law.

9. Third-party services and links

The Service relies on and may link to third parties, such as Stripe for payments and Tumblr as the source of public data. Your use of those services is governed by their own terms and policies. We are not responsible for third-party services, their availability, or their actions, and we make no guarantees about Tumblr's continued availability or the accessibility of any given post.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. While we design the randomization to be fair and the tool to be reliable, we do not warrant that the Service will be uninterrupted, error-free, or able to access every post at all times. You use the Service at your own risk.

11. Limitation of liability

To the maximum extent permitted by law, TblrPicker and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or opportunity, arising out of or related to your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the amount you paid us in the three months preceding the event giving rise to the claim, or, if you used the Service for free, a nominal amount.

12. Indemnification

You agree to indemnify and hold harmless TblrPicker and its team from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your giveaways, or your breach of these Terms or of any law or third-party right.

13. Termination

We may suspend or terminate your access at any time if you breach these Terms or if we discontinue the Service. You may stop using the Service at any time. Provisions that by their nature should survive termination — including ownership, disclaimers, and limitations of liability — will survive.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we'll update the "Last updated" date and, where appropriate, provide further notice. Continuing to use the Service after changes take effect means you accept the revised Terms.

15. Governing law and contact

These Terms are governed by the applicable laws of our operating jurisdiction, without regard to conflict-of-law principles. If any provision is found unenforceable, the remaining provisions stay in effect. For any questions about these Terms, contact us at [email protected].
